The American Law of Product Liability, Safety, and Information: A Field Sketch

Abstract: This essay briefly sketches the three kinds of law in the United States that concern product-related injuries. Product liability law holds product makers and sellers responsible for already occurred injuries. Product safety law aims to prevent injuries. The “law of product information” consists of the laws that support a particular kind of regulatory strategy: give consumers enough information so that they can use their market power to avoid buying, or pay much less for, unsafe or otherwise low-quality products.
